Terms of Service

These Terms of Service ("Terms") govern your use of the PersonaForge platform at personaforge.xyz operated by PersonaForge ("we," "us," or "our"). By creating an account or using our services, you agree to these Terms.

1. Services

PersonaForge provides an AI-powered content studio that allows you to train personal LoRA models ("AI Twins") from your photos and use them to generate images, videos, and virtual try-on content. Access to certain features requires a paid subscription and/or credits.

2. Account Registration

• You must be at least 16 years old to use PersonaForge.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorized access to your account.

3. Subscriptions and Billing

3.1 Plans

PersonaForge offers subscription plans (Starter, Pro, Studio) with different feature sets and credit allowances. Plan details and pricing are displayed on our pricing page and may change with 30 days' notice.

3.2 Auto-Renewal

Subscriptions renew automatically at the end of each billing period. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you retain access until then.

3.3 Credits

Credits are the currency used for AI generation tasks (image generation, video generation, virtual try-on, LoRA training). Each plan includes a monthly credit allowance. Additional credit packs can be purchased separately. Credits do not expire as long as your account is active.

4. User Content

4.1 Your Uploads

You retain full ownership of the photos and media you upload to PersonaForge. By uploading content, you grant us a limited, non-exclusive license to process, store, and transmit that content solely for the purpose of providing our services to you (training your AI Twin, generating content, displaying previews).

4.2 Generated Content

You own the images and videos generated through PersonaForge using your AI Twin. You may use generated content for personal and commercial purposes, subject to the restrictions in Section 6.

4.3 AI Twin Models

The LoRA model weights created from your training data are associated with your account. When you delete a Twin or your account, the model weights and associated training data are permanently deleted from our systems within 30 days.

5. Third-Party AI Providers

PersonaForge uses Fal.ai for AI model training and image generation, and Kling for video generation. Your content is transmitted to these providers for processing and is not retained by them beyond the completion of each task, per their respective data processing agreements. We are not responsible for the actions of third-party providers beyond our contractual obligations with them.

6. Prohibited Uses

You agree not to use PersonaForge to:

• Generate content depicting real people without their explicit consent.
• Create non-consensual intimate imagery or deepfakes.
• Generate content that exploits or harms minors in any way.
• Produce content promoting violence, terrorism, or hate speech.
• Create misleading or fraudulent content intended to deceive others.
• Violate any applicable laws, regulations, or third-party rights.
• Attempt to reverse-engineer, extract, or redistribute AI model weights.
• Use automated tools to scrape, crawl, or overload our platform.
• Circumvent usage limits, security measures, or content moderation.

7. Content Moderation

We reserve the right to review, flag, or remove content that violates these Terms or our acceptable use standards. We may use automated systems and manual review to enforce these policies. Repeated or severe violations may result in account suspension or termination.

8. Intellectual Property

The PersonaForge platform, including its design, code, brand assets, and underlying technology, is owned by PersonaForge and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or proprietary technology beyond what is necessary to use the services.

9. Disclaimer of Warranties

PersonaForge is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error-free, or that generated outputs will meet your expectations. AI-generated content may contain imperfections, artifacts, or inaccuracies. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, PersonaForge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities. Our total liability for any claim related to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold PersonaForge harmless from any claims, damages, or expenses arising from your use of the platform, your content, or your violation of these Terms.

12. Termination

• By you: You may delete your account at any time from your settings page. Upon deletion, your AI Twins, generated content, and personal data will be permanently removed within 30 days.
• By us: We may suspend or terminate your account if you violate these Terms, engage in prohibited activities, or if required by law. We will notify you unless prohibited from doing so.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Tallinn, Estonia.

14. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website at least 30 days in advance. Continued use of PersonaForge after the effective date constitutes acceptance of the updated Terms.
